General Terms and Conditions (GTC) for orders via www.1asales.ch
The General Terms and Conditions (hereinafter referred to as “GTC”) apply to all orders placed and contracts concluded (hereinafter referred to as “order”) via the 1asales.ch online shop.
1asales reserves the right to change the General Terms and Conditions at any time. The version of the General Terms and Conditions valid at the time of the order is decisive and cannot be changed unilaterally for this order.
ORDER, PRICE AND PAYMENTS
1.1 The offer is aimed at natural and legal persons. Deliveries are only made to addresses in Switzerland, Germany, Liechtenstein, Austria, France and Italy.
1.2 The offer is valid while stocks last. Prices and product ranges are subject to change at any time.
1.3 The payment options Twint, Mastercard, Visa, American Express and Paypal are offered. We reserve the right not to accept certain payment methods for each order and to refer you to an alternative.
1.4 Payments are accepted in Swiss francs and euros. Any transaction costs are borne by the buyer.
1.5 By completing the purchase process in the online shop - "buy" - the order is binding and is immediately confirmed by email, whereby the purchase contract becomes valid. The subsequent delivery takes place after receipt of payment of the full purchase price including any shipping costs. In the case of advance payment, the goods are reserved until the agreed purchase price has been received by us. Delivery takes place immediately after receipt of the purchase price. Payment in advance is expected with the next possible value date after receipt of the order, but no later than within 7 working days.
1.6 All dresses are vintage or second-hand. The labelling of the individual article is purely informative according to the sewn-in label.
1.7 Any type of voucher that can be redeemed at 1asales cannot be used cumulatively.
DELIVERY
2.1 The delivery costs depend on the value of the products ordered (minimum order value excl. delivery costs) and the buyer's place of residence. The following applies to orders within Switzerland and Lichtenstein: For orders over CHF 110, no delivery costs are charged, otherwise the delivery costs are CHF 8.50. The following applies to orders from France, Italy, Austria and Germany: For orders over EUR 200, no delivery costs are charged, otherwise the delivery costs are EUR 18.00. The delivery costs are listed as an additional item in the shopping cart and on the invoice.
2.2 We deliver within Switzerland, Germany, Lichtenstein, Austria, France and Italy. The delivery time is normally 2-7 working days for deliveries within Switzerland and Lichtenstein. The delivery time for Germany, Austria and France is between 4 - 14 working days. The delivery time for Italy is 6-18 working days, but delivery delays are reserved in exceptional cases. Claims for damages due to delayed or non-delivery are excluded.
GUARANTEE
3.1The buyer of a product has no guarantee.
CLAIMS FOR DAMAGES
4.1 Unfortunately, we cannot accept claims for damages due to errors in images, prices and texts. We ask for your understanding.
RETURN
5.1 The garments cannot be returned to us at this time.
LIABILITY AND FURTHER INFORMATION
6.1 From the moment of delivery, the products are subject to your liability.
6.2 Ownership of the Products will not pass to you until you have received full payment of all amounts due for the Products, including transport costs, or upon delivery if delivery is not made until after full payment has been made.
6.3 Should individual provisions of the contract, including these regulations, be or become invalid in whole or in part, or should the contract contain an unforeseen gap, the validity of the remaining provisions or parts of such provisions shall remain unaffected. The respective statutory provisions shall take the place of the invalid or missing provisions.
APPLICABLE LAW AND JURISDICTION
7.1 Swiss law applies to all legal transactions or other legal relationships with us. The UN Convention on Contracts for the International Sale of Goods (CISG) and any other intergovernmental agreements do not apply. In the case of contracts for a purpose that cannot be attributed to the professional or commercial activity of the entitled party (contract with consumers), this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his or her habitual residence.
7.2 With regard to consumers, the place of jurisdiction is the Swiss place of residence of the consumer. In business dealings with merchants, the place of jurisdiction for all legal disputes concerning these terms and conditions and individual contracts concluded under their validity, including bills of exchange and checks, is our place of business. In this case, we are also entitled to sue at the customer's place of residence.
